Pennsylvania Hepatitis-A Victims' Attorneys Ask Bankruptcy Court To Lift Stay

Wilmington, Delaware-Marler Clark, Seattle food illness attorneys, and Phillips, Goldman & Spence, Wilmington, a Delaware bankruptcy law firm, filed motions to lift the stay of bankruptcy today in Delaware Bankruptcy Court on behalf of 58 victims of the Chi-Chi's Hepatitis-A outbreak in Beaver County, Pennsylvania. One of the motions is for liver transplant victim Richard Miller, who filed suit in Federal Court in Pennsylvania two weeks ago against the suppliers of alleged Hepatitis-A tainted green onions, Castellini Company, Newstar Fresh Foods, Apio Fresh and Boskovich Farms.

"We are asking the Court to lift the stay so these defendants can be in one courtroom in Federal Court. We believe that this will allow a jury to determine how this tragedy occurred and how we can prevent it from ever happening again," said attorney, William Marler.

"We not only need to find out who is responsible for the injuries of over 650 people and the deaths of three, but these people need to be compensated for their injuries and loss. Having the entire chain of distribution of these green onions in one suit will assure fair compensation for all victims," added Marler.
