Is there a limit on the time we have in which to file a medical malpractice claim?
The statute of limitations on most medical malpractice claims in the state of Pennsylvania is 2 years. There are exceptions to this rule, as in cases where the victim is a minor (Minor's Tolling Statute) and when the injury itself has gone undetected beyond that period of time (The Discovery Rule.)
Will we have to appear in court?
Most medical malpractice cases are settled outside of the courtroom. It is uncommon that a trial is required in a medical malpractice case. This is to your advantage because the settlement of a claim permits the victim or their family to have direct input into the solution that is crafted as opposed to awaiting the decision of twelve strangers (the jury.)
